A draft U.S. supreme court decision was leaked to Politico. The draft opinion, written by Justice Samuel Alito, indicates that a majority of justices will vote to overturn Roe v. Wade.

Alito writes,

“Roe was egregiously wrong from the start. Its reasoning was exceptionally weak, and the decision has had damaging consequences. And far from bringing about a national settlement of the abortion issue, Roe and Casey have enflamed debate and deepened division.”

Clearly, the leaking of the draft opinion is a desperate attempt to change one or more votes. While this may be the first time an entire draft opinion has been leaked, there were leaks about the Obamacare decision that indicated Obamacare would be upheld. Justice Roberts has instructed the Marshal of the supreme court to find the leaker.

Roe is one of the most notorious decisions ever decided by the supreme court. It is right up there with Dred Scott.

It ought never to have been decided by the federal judiciary. Nothing in the constitution gives the federal judiciary jurisdiction to decide abortion related matters. Up until 1973, it had always been a state issue with some states legalizing it and most others restricting it.

If Roe is overturned, abortion will still be legal in most states. Abortion will simply revert to the states where legislators will decide their own laws on abortion. Some will ban it outright. Other states will make it legal all the way up to the moment of birth. Other states will have to decide for themselves how far to restrict or liberalize abortion.

Of course, the political meltdown amongst the liberal ruling elite was predictable. Many federal politicians on the left are committed to keeping abortion the most protected institution of the state since slavery.

Considering Congress’ penchant for meddling in state affairs, overturning Roe also means state and federal elections this fall and on into the future will take on greater importance.  

Increasing inflation, economic pressures from shutting down the country over covid and the war with Russia, along with the coming collapse of the dollar, and now the likely overturning of Roe will only deepen the fault lines in America.

The day is coming when states will secede from the union and go their own way.
