Attorney Robert Barnes writes,
- It is time to judge the judges.
- As forewarned by the anti-Federalists centuries ago, the judicial branch wandered from its Constitutional roots long ago, and now threatens the Constitutional Republic. Repeatedly, the courts usurp the power of the Presidency and try to overthrow the election of 2024. To date, they repeatedly ruled the President cannot: hire and fire his own employees; withhold funds from causes Congressionally unapproved for appropriations; remove access to classified information from rogue law firms; ban dangerous aliens from our shores; declassify materials for the American people; determine citizenship by birth; enforce immigration law; disclose audited records of taxpayer funds; stop the censorship of Americans; or even stop funding coups overseas.
- This fills a background of judicial Constitutional incompetency and intellectual decrepitude. The first Supreme Court played the same wayward role, with Justice Samuel Chase weaponizing the courts against their popularly elected ideological adversaries, culminating in his impeachment. Justice Marshall self-anointed role of Philosopher King to “declare what the law is”, overriding the oaths of all other elected officials and usurping the role of Constitutional truth telling from the elected branches of government. Marshall followed that up with setting the foundation for the Trail of Tears by declaring Indian land title null-and-void (failing to disclose his conflict of interest, as his wealth was tied to land grants originating from non-tribal title). The Court then succeeded that by triggering the Civil War in its Dred Scott decision that ignored its own Amistad precedence about slavery. The Court followed that up with eviscerating the Civil Rights Act through its segregation decisions of “separate but equal” and then ignoring the complete denial of Constitutional rights to southerners for several generations. The Court succeeded its first century of mostly infamy with another century of dubious distinction, with its eugenics celebrations and its trilogy of infamy – Jacobson (approving forced vaccinations), Buck (approving eugenics and forced sterilizations), and then Korematsu (supporting detention camps for American citizens during war time).
- The Court’s Exxon “deference” then greenlit the unelected Bureaucracy’s capture of American governmental power, empowered a cultural revolution against the traditional values of the American people by forcing abortion and gay marriage upon un-consenting populations, and hid behind national security to immunize the Deep State and corrupt politicians with selective sovereign immunity, as if we restored a King to power. When the people elect someone the courts disfavor, they utilize their judicial power to usurp and overturn the people’s wishes, whether it’s role in the removal of Nixon or its repeated role withholding power from Trump. The judicial branch’s inane actions over the last several months reveal the need to restrain and reform the judicial branch of government.
- The tools afforded the other branches of government include: first, impeachment and removal proceedings for federal judges not performing their oath and engaging in bad behavior, as the Constitution requires judges engage in “good behavior” or be subject to removal; second, modifying the jurisdiction of judges below the Supreme Court, over which Congress enjoys plenary power, including removing jurisdiction, ending judicial districts in DC and SDNY, and establishing vicinage rights for all individual litigants to remove cases to their home jurisdiction; the use of the purse, in removing budgeted items from the judicial branch of government; the use of the sword, in removing executive enforcement branch powers from the judiciary, by removing the Marshalls from their supervisory control; and the empowerment of the DOJ to investigate and, where appropriate, indictment of rogue jurists aiding and abetting criminal activity and insurrectionary acts by the judicial branch.
